In capital cases, the Board may consider an application for commutation of sentence to a lesser penalty and for reprieve of a scheduled execution. The application must be received at least 21 days prior to the scheduled execution date. If a majority of the Board makes a written recommendation for clemency, the Governor may grant commutation or a reprieve. The Governor also has the power to grant a one-time reprieve of execution not to exceed thirty (30) days without a Board recommendation.
